Welcome to DigitalTable. We respect your privacy and are committed to protecting the personal data of our users. This Privacy Policy explains how DigitalTable ("we," "us," or "our") collects, uses, shares, and protects information when you use our restaurant management software, point-of-sale (POS) system, and QR-based digital ordering services (collectively, the "Service").

This policy applies to two main categories of users:

  • Merchants: Restaurant owners, managers, and staff who subscribe to and use the Service to manage their business.
  • Diners: End-customers who scan a DigitalTable QR code at a Merchant’s location to view a menu, place an order, or make a payment.

1. Information We Collect

A. Information Collected from Merchants

When you register for a DigitalTable account or use our Service as a Merchant, we collect:

  • Account Information: Name, business name, email address, phone number, and physical restaurant address.
  • Business Data: Menu items, pricing, inventory details, employee configurations, and sales analytics.
  • Billing Information: Subscription payment details. (Note: Credit card processing for subscriptions is handled by our secure third-party payment processors; we do not store full credit card numbers.)

B. Information Collected from Diners

When a Diner accesses our digital menu via a QR code, we may collect:

  • Contact Information: Phone numbers, if provided by the Diner to receive order status updates via messaging platforms (e.g., WhatsApp API) or digital receipts.
  • Order Details: Items ordered, table number, order time, and special instructions.
  • Device and Usage Data: IP address, browser type, device type, and time spent on the digital menu page.
  • Payment Information: If a Diner pays digitally, the transaction is processed directly through secure third-party payment gateways (e.g., Razorpay). DigitalTable does not collect, store, or process Diner credit card or UPI details.

2. How We Use the Information

For Merchants:

  • To provide, maintain, and support the POS software.
  • To process subscription billing.
  • To send administrative notifications, technical updates, and security alerts.
  • To aggregate anonymized sales data for platform performance analytics.

For Diners:

  • To transmit the order directly to the Merchant’s kitchen or admin panel.
  • To send real-time order status notifications (e.g., via WhatsApp) and digital receipts, if requested.
  • To facilitate the seamless handoff to third-party payment processors for order checkout.

3. How We Share Information

We do not sell personal data to third parties. We only share information under the following circumstances:

  • With the Merchant: Diner order details and provided contact information are shared directly with the specific restaurant where the Diner placed the order. The Merchant is the primary data controller of their Diners' information.
  • With Service Providers: We use third-party infrastructure to run our Service, including cloud hosting providers, communication APIs (for sending WhatsApp order updates), and secure payment gateways (like Razorpay) to process transactions.
  • For Legal Compliance: We may disclose information if required by law, court order, or government regulation, or to protect the rights, property, and safety of DigitalTable, our users, or the public.

4. Merchant Responsibilities Regarding Diner Data

Merchants using DigitalTable act as the "Data Fiduciary" (or Data Controller) for their own Diners. Merchants are strictly responsible for:

  • Complying with all applicable data privacy laws regarding the collection and use of Diner phone numbers or emails.
  • Obtaining necessary consent before using Diner data for independent marketing or promotional campaigns outside of standard order fulfillment.

5. Data Security and Retention

We implement industry-standard technical and organizational measures to protect data against unauthorized access, loss, or alteration.

Retention: We retain Merchant data for as long as the account is active. If an account is canceled, we will delete or anonymize the data in accordance with our internal policies, unless legally required to retain it. Diner order history is retained as part of the Merchant's sales records.

6. Your Data Rights

Depending on applicable laws (such as the DPDP Act in India), users may have the right to:

  • Request access to the personal data we hold about them.
  • Request correction of inaccurate or incomplete data.
  • Request deletion of their personal data (subject to legal and operational requirements).

Merchants can update their profile within the admin dashboard. Diners wishing to exercise their data rights regarding an order should contact the Merchant directly, as the Merchant holds the operational record of the transaction.
